Bow Studio Books (“we”, “us”, “our”) operates this website and provides both physical goods and digital content for sale.
2. Scope and Application
(1) These Terms and Conditions (“Terms”) apply to all contracts between Bow Studio Books and customers (“you”, “buyer”, “user”) concerning the sale and delivery of both physical goods and digital products via the website www.bowstudiobooks.com.
(2) By purchasing through our website, you agree to these Terms in accordance with Sections 305 et seq. of the German Civil Code (Bürgerliches Gesetzbuch – BGB).
(3) Deviating terms and conditions of the customer shall not apply unless expressly agreed in writing.
3. Products and Services
(1) Bow Studio Books offers:

Physical products such as printed books, journals, or other tangible goods.

Digital products such as downloadable e-books, guides, and digital journals (“digital content”) within the meaning of Section 327 (2) BGB.
(2) Product details, descriptions, and prices are available on the website. Minor variations in design or presentation are possible and do not constitute a defect.
4. Conclusion of Contract (§§ 145 ff. BGB)
(1) The presentation of products on the website does not constitute a legally binding offer but an invitation to submit an order.
(2) By clicking “Buy Now” or “Add to Cart” and completing the checkout process, you make a binding offer to purchase the selected products.
(3) The contract is concluded when we send an order confirmation or dispatch the goods, whichever occurs first.
(4) Orders can only be placed by individuals who are at least 18 years of age.
5. Prices and Payment
(1) All prices are listed in Euro (EUR) and include the applicable statutory VAT under Section 1 UStG, unless otherwise stated.
(2) Payments are due immediately upon order and may be made using the payment methods offered on our website (e.g., PayPal, credit card, Stripe, or Wix Payments).
(3) The customer bears any transaction or currency conversion fees charged by the payment provider.
6. Delivery and Shipping (Physical Goods)
(1) Physical goods are shipped to the delivery address specified by the customer.
(2) Shipping costs, if applicable, are displayed during checkout.
(3) Delivery times vary depending on the destination and are indicated on the product page.
(4) If an item is temporarily unavailable, we will inform you promptly.
(5) Risk of accidental loss or deterioration of the goods passes to the customer upon handover to the shipping carrier, provided the customer is an entrepreneur (§ 447 BGB). For consumers, the risk passes only upon receipt.
7. Delivery of Digital Content (§ 327 BGB)
(1) Digital products are delivered electronically via download link or email after payment has been received.
(2) Delivery is deemed complete once the download link has been transmitted.
(3) The customer is responsible for providing a valid email address and ensuring compatibility with standard formats (PDF, EPUB, ZIP, etc.).
8. Right of Withdrawal (Physical Goods)
(1) Consumers have a 14-day right of withdrawal for physical goods in accordance with Sections 312g and 355 BGB.
(2) You may withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day you (or a third party other than the carrier) receive the goods.
(3) To exercise your right of withdrawal, you must notify us by email at hello@bowstudiobooks.com with a clear statement of your decision to withdraw.
(4) Consequences of withdrawal:

You must return the goods to us without undue delay and no later than 14 days from the date you informed us of your withdrawal.

You bear the direct cost of returning the goods.

We will refund the purchase price (excluding delivery costs, if applicable) using the same payment method used for the initial transaction.

We may withhold reimbursement until we have received the goods or proof of return.
(5) The right of withdrawal does not apply to:

Goods made to the customer’s specifications or clearly personalized.

Sealed goods that are unsuitable for return for health or hygiene reasons once unsealed.
9. Right of Withdrawal (Digital Content)
(1) For digital products, the right of withdrawal expires once:

You have expressly consented to the immediate delivery of the digital content, and

You have acknowledged the loss of your right of withdrawal, in accordance with Section 356 (5) BGB.
(2) By completing your purchase and downloading the file, you consent to immediate delivery and waive your statutory withdrawal right.
(3) Therefore, all digital product sales are final and non-refundable, except where required by law.
10. License and Use Rights (Digital Content)
(1) Upon full payment, Bow Studio Books grants you a non-exclusive, non-transferable, revocable license to use the purchased digital content for private, non-commercial purposes.
(2) You may not:

Share, resell, or distribute the content to third parties.

Upload the files to public websites or file-sharing platforms.

Alter, adapt, or use the content for commercial projects.
(3) All rights, titles, and interests in the digital content remain the property of Bow Studio Books. Unauthorized use constitutes an infringement of Sections 97 et seq. UrhG (German Copyright Act).
11. Retention of Title (Physical Goods)
(1) Physical goods remain the property of Bow Studio Books until full payment has been received.
(2) Until ownership is transferred, the buyer must handle the goods with care and may not resell or pledge them without our consent.
12. Defects and Warranty (Physical Goods)
(1) Warranty rights for consumers are governed by Sections 434 et seq. BGB.
(2) If the goods are defective, you are entitled to statutory warranty rights, including repair, replacement, or refund, depending on the circumstances.
(3) Minor variations in appearance or packaging that do not affect the function or quality of the product are not considered defects.
(4) For entrepreneurs, warranty claims expire 12 months after delivery of the goods.
13. Limitation of Liability
(1) Bow Studio Books is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health.
(2) In cases of simple negligence, we are liable only for the breach of essential contractual duties (cardinal obligations) and limited to the foreseeable damage typical for the contract.
(3) Liability for indirect damages, loss of profit, or consequential damages is excluded.
(4) The digital content and products are for informational and educational purposes only and do not constitute professional, psychological, or medical advice.
14. Data Protection
Personal data is processed in compliance with the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and our Privacy Policy, available on our website.
15. Governing Law and Jurisdiction
(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers within the EU, the mandatory consumer protection provisions of their country of residence remain unaffected.
(3) If the customer is a merchant or legal entity under public law, the exclusive place of jurisdiction is the registered office of Bow Studio Books.
16. Online Dispute Resolution and Arbitration
(1) The European Commission provides a platform for online dispute resolution (ODR):

(2) We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board under the German Consumer Dispute Resolution Act (VSBG).
17. Amendments to the Terms
We may amend these Terms at any time with effect for the future. The version valid at the time of the order applies. Updated versions will be published on our website and take effect upon publication.
18. Severability Clause
If any provision of these Terms is found invalid, the remaining provisions shall remain valid and enforceable. The invalid provision shall be replaced by a valid one that best reflects the intended purpose.
